Please read these terms carefully. By using vanityhair.co.za or placing an order, you agree to them.

2. Definitions
“We”, “us” and “our” mean Vanity Hair. “You” and “your” mean the person using the website or placing an order. “Products” means the goods offered for sale on the website. “Order” means your request to buy Products.
3. Using the website
You may use this website for lawful purposes only. You may not attempt to gain unauthorised access to the website, interfere with its operation, or copy, reproduce or republish its content without our written permission. All text, images, logos and branding on this website are owned by us or our suppliers and are protected by law.
We take reasonable care to keep the website accurate and available, but we do not warrant that it will be uninterrupted or error free.
4. Products and pricing
All prices are shown in South African Rand and include VAT where applicable. Product images are for illustration; packaging and presentation may vary.
We try to ensure all information is accurate, but errors can occur. Where a Product is listed at an incorrect price due to an obvious error, we are not obliged to sell at that price. If this happens after you have paid, we will contact you and offer to either proceed at the correct price or cancel and refund you in full.
Products are subject to availability. Where a Product is unavailable after you have ordered, we will notify you and refund you in full.
5. Orders and when a contract is formed
Placing an order is an offer to buy. Your order is accepted, and a contract formed, only once we confirm acceptance and payment has cleared. We may decline an order where the Product is unavailable, where payment is not authorised, or where we reasonably suspect fraud.
6. Payment
Payments are processed by Payfast. We do not receive or store your full card details. You warrant that you are authorised to use the payment method supplied. Orders are dispatched only once payment has cleared.
7. Delivery
Delivery is governed by our Delivery Policy, which forms part of these terms. Risk in the Products passes to you on delivery; ownership passes once payment has been received in full.
8. Cancellation, returns and refunds
Your right to cancel, return Products and receive a refund is set out in our Refund and Returns Policy, which forms part of these terms and includes the 7 day cooling-off right under the Electronic Communications and Transactions Act.
9. Limitation of liability
Our Products are cosmetic haircare items intended for external use as directed. Please read and follow the instructions and discontinue use if irritation occurs. We are not liable for any reaction, loss or damage arising from misuse, use contrary to instructions, or an allergy or sensitivity to an ingredient.
To the fullest extent permitted by law, our total liability arising from any order is limited to the amount you paid for that order. Nothing in these terms excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act.
10. Privacy
We collect and process your personal information in line with the Protection of Personal Information Act 4 of 2013. We use your information to process orders, arrange delivery and communicate with you about your order. We do not sell your information.
11. Complaints
Please send complaints to sales@vanityhair.co.za with your order number and a description of the issue. We will acknowledge receipt and respond within 5 business days.
12. Governing law
These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
13. General
These terms, together with the Delivery Policy and the Refund and Returns Policy, form the entire agreement between you and us. If any provision is found unenforceable, the remaining provisions continue to apply. Our failure to enforce a right does not waive it. You may not cede or assign your rights under these terms without our written consent.
We are not liable for any failure or delay caused by circumstances beyond our reasonable control, including load shedding, strikes, courier failures, natural events or acts of state.
14. Changes to these terms
We may update these terms from time to time. The version published on this website at the time you place an order is the version that applies to that order.
